1. Acceptance of Terms
By downloading, installing, accessing, or using the SafeCheckNow mobile application ("the App") or any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
SafeCheckNow is owned and operated by MKF Technologies LLC ("we," "us," or "our"), a Florida limited liability company.
2. Description of Service
SafeCheckNow is a safety and wellness check-in application that allows users to:
- Complete daily wellness check-ins
- Designate emergency contacts to receive notifications
- Request assistance or callbacks from designated contacts
- Automatically alert designated contacts if a scheduled check-in is missed
The App is intended for personal safety and wellness purposes only and is not a substitute for emergency services. In case of emergency, always call 911 or your local emergency services.
3. SMS/Text Messaging Terms
By using SafeCheckNow and adding emergency contacts, you acknowledge and agree to the following:
- The phone numbers you add as emergency contacts will receive SMS/text messages from SafeCheckNow
- Messages are sent only when: (1) you request immediate help, (2) you request a callback, or (3) you miss a scheduled check-in
- All messages are transactional and safety-related; no marketing or promotional messages are sent
- Message frequency varies based on your activity (typically 0-3 messages per week)
- Message and data rates may apply to message recipients
- Message recipients can opt out at any time by replying STOP
- You have obtained permission from your emergency contacts before adding their phone numbers

4. User Responsibilities
By using SafeCheckNow, you agree to:
- Provide accurate and complete information when creating your account and adding contacts
- Obtain consent from individuals before adding them as emergency contacts
- Keep your account information and contact list up to date
- Use the App only for its intended purpose of personal safety and wellness check-ins
- Not use the App for any unlawful, harmful, or fraudulent purpose
- Not misuse the emergency alert features
- Not attempt to reverse engineer, modify, or interfere with the App's functionality
5. Account Registration
To use certain features of the App, you may need to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or use of your account
You must be at least 13 years old to create an account. Users under 18 must have parental or guardian consent.
6. Privacy
Your use of SafeCheckNow is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our collection and use of information as described in the Privacy Policy.
7. Intellectual Property
The App, including its design, features, content, and underlying technology, is owned by MKF Technologies LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You may not:
- Copy, modify, or distribute the App or its content
- Use our trademarks or branding without written permission
- Remove any copyright or proprietary notices from the App
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure
- Messages will be delivered successfully to all recipients
- The App will meet your specific requirements or expectations
SafeCheckNow is not a substitute for emergency services. We are not responsible for any failure to contact emergency services or designated contacts. Always call 911 or local emergency services in life-threatening situations.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MKF TECHNOLOGIES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of data, revenue, profits, or business opportunities
- Any damages arising from your use or inability to use the App
- Any failure of SMS messages to be delivered or received
- Any actions taken or not taken by your designated contacts
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100, whichever is greater.
10. Indemnification
You agree to indemnify, defend, and hold harmless MKF Technologies LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content or information you provide through the App
11. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may terminate your account at any time by deleting the App and contacting us to request account deletion.
Upon termination:
- Your right to use the App will immediately cease
- We may delete your account data in accordance with our Privacy Policy
- Provisions that should survive termination (such as limitations of liability) will remain in effect
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes through:
- In-App notification
- Email to your registered address
- Posting updated Terms on our website
Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of such courts.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MKF Technologies LLC regarding your use of SafeCheckNow and supersede any prior agreements.
