1. Introduction

This Privacy Policy explains how SafeCheckNow ("the App") collects, uses, and protects personal information. By using SafeCheckNow, you agree to the terms outlined in this policy.

2. Information We Collect

We collect information you provide directly, including:

  • Name, phone number, and email address
  • Emergency contact details
  • Check-in status and responses
  • Check-in schedules and preferences

We also collect limited technical information, including:

  • Device type and operating system
  • IP address
  • Crash logs and error reports
  • Notification delivery status
  • Approximate location data (device location for service functionality only)

3. No PHI or Medical Data

SafeCheckNow does not collect or store medical records or Protected Health Information (PHI) and is not a HIPAA-covered service. The App is designed for safety check-ins and does not process health-related data.

4. Use of Information

Information is used solely to:

  • Operate the App and send check-in notifications
  • Deliver notifications to your designated contacts
  • Improve App functionality and user experience
  • Provide customer support
  • Maintain security and prevent fraud
  • Comply with legal obligations

5. SMS/Text Messaging

SafeCheckNow sends SMS/text messages to emergency contacts designated by users. This section describes our SMS messaging practices in detail.

Types of Messages Sent:

SMS messages are sent only in the following circumstances:

  • User Requests Immediate Help: When a user completes a check-in and requests urgent assistance
  • User Requests a Callback: When a user completes a check-in and requests a non-urgent callback
  • Missed Check-In Alert: When a user fails to complete their scheduled daily check-in within the grace period

All messages are transactional, safety-related, and user-initiated. No marketing, advertising, or promotional content is ever sent.

How Consent is Obtained:

Consent for SMS messaging is obtained through an explicit, user-initiated opt-in process within the SafeCheckNow mobile application:

  • Users navigate to Settings → Emergency Contacts in the app
  • Before adding contacts, users see a disclosure stating: "These contacts will be notified if you miss your daily check-in or request a call"
  • Users manually enter the contact's name and phone number
  • By tapping "Add Contact," users provide explicit consent for that phone number to receive safety-related SMS messages

Only phone numbers explicitly added by users will receive messages. Users control which contacts receive notifications and can remove contacts at any time.

Message Frequency:

Message frequency varies based on user activity. Emergency contacts will only receive messages when triggered by specific user actions (requesting help or a callback) or user inactivity (missed check-in). Typical frequency is 0-3 messages per week, depending on user behavior.

Message recipients can opt out of SMS messages at any time by:

After opting out, you will receive a confirmation message and will not receive further SMS messages from SafeCheckNow unless you re-subscribe by replying START.

Message and data rates may apply. Please contact your mobile carrier for details about your text messaging plan.

Carriers:

SafeCheckNow SMS messages are delivered through major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

6. Third-Party Service Providers

We use third-party services to operate SafeCheckNow:

Twilio - We use Twilio's messaging service to send SMS notifications. When you receive SMS messages from SafeCheckNow, Twilio processes your phone number and message content. Twilio's use of your information is governed by their privacy policy, available at: https://www.twilio.com/legal/privacy.

We select service providers that maintain appropriate data security standards and are contractually obligated to protect your information.

7. Sharing of Information

We may share your information only in the following circumstances:

  • Designated Contacts: Information is shared with emergency contacts you designate within the App when check-ins are missed or emergency alerts are triggered
  • Service Providers: Third-party providers (such as Twilio) necessary to operate the App's core functionality
  • Legal Requirements: Law enforcement or government authorities when legally required or to protect rights and safety
  • Business Transfers: In connection with a merger, acquisition, or sale of assets (users will be notified)

We do not sell, rent, or trade your personal information to third parties for marketing purposes.

8. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information, including:

  • Encrypted data transmission (SSL/TLS)
  • Secure server infrastructure
  • Access controls and authentication
  • Regular security assessments

However, no system is completely secure. We cannot guarantee absolute security of information transmitted over the internet.

9. Children's Privacy

SafeCheckNow may be used by minors only with explicit parental or guardian consent. We do not knowingly collect personal information from children under 13 without verifiable parental consent. If we learn we have collected information from a child under 13 without consent, we will delete it promptly.

10. Data Retention

We retain your information only as long as necessary to:

  • Provide App services while your account is active
  • Comply with legal obligations
  • Resolve disputes and enforce agreements

Specific Retention Periods:

  • Active account data: Retained while account is active
  • Deleted account data: Purged within 30 days of account deletion
  • Technical logs: Retained for 90 days
  • Legal compliance records: Retained as required by law

You may request account deletion at any time through the process described in Section 11.

11. Your Rights and Choices

You have the following rights regarding your personal information:

  • Access and Correction: Request access to or correction of your personal information by contacting us at info@safechecknow.com or through the App settings.
  • Deletion: Request deletion of your account and associated data by emailing info@safechecknow.com with subject line "Account Deletion Request." We will process deletion within 30 days.
  • Opt-Out: Unsubscribe from non-essential communications through App settings or by contacting us.
  • Data Portability: Request a copy of your data in a portable format.

State-Specific Rights

California Residents (CCPA): California residents have additional rights under the California Consumer Privacy Act, including:

  • Right to know what personal information is collected, used, shared, or sold
  • Right to delete personal information (with certain exceptions)
  • Right to opt-out of sale of personal information (Note: We do not sell personal information)
  • Right to non-discrimination for exercising CCPA rights

Continued use of SafeCheckNow after changes are posted constitutes acceptance of the updated policy.
